1. About DineSwipe
By accessing or using the DineSwipe website or services, you agree to be bound by these Terms.
DineSwipe is a technology platform that provides software tools for restaurants and food businesses to manage digital menus, orders, billing, payments, and operational communication.
DineSwipe does not:
- Operate restaurants.
- Prepare or sell food.
- Control pricing, taxes, or service quality.
- Act as a seller, reseller, or delivery provider.
All food-related services are provided solely by the respective restaurants or merchants.
2. Eligibility & Use
The DineSwipe Platform may be accessed by end customers of all ages for the purpose of viewing menus, placing orders, and making payments through participating restaurants.
Merchant accounts, administrative access, and contractual use of the Platform may only be created and operated by individuals who are at least 18 years of age and legally capable of entering into binding agreements under applicable law.
Restaurants and merchants are solely responsible for ensuring that their use of the Platform complies with all applicable laws and regulations.
3. Platform Access & Usage
You agree to:
- Use the Platform only for lawful purposes.
- Not misuse, copy, reverse-engineer, or interfere with the Platform.
- Provide accurate and complete information when required.
We reserve the right to suspend or restrict access if misuse, abuse, or illegal activity is detected.
4. Merchants & Separate Agreements
If you are a restaurant or food business ("Merchant"), your relationship with DineSwipe is governed by a separate Merchant Agreement executed between you and Piriyathu LLP.
In the event of any conflict between these Terms and the Merchant Agreement, the Merchant Agreement shall prevail.
5. Payments & Third-Party Services
Payments initiated through DineSwipe are processed via independent third-party payment gateways.
- DineSwipe does not control payment authorization, settlement, or reversals.
- We are not responsible for payment failures, chargebacks, or delays.
- DineSwipe is not a payment intermediary or escrow service.
All payment-related services are governed by the terms and conditions of the respective payment gateway.
6. Service Availability & Downtime
DineSwipe may experience planned maintenance downtime or unplanned service interruptions due to technical issues or third-party dependencies.
We do not guarantee uninterrupted or error-free operation and shall not be liable for any loss arising from service unavailability or downtime.
7. Intellectual Property
All software, content, trademarks, and materials available on the Platform are the exclusive property of Piriyathu LLP.
No rights are granted except the limited right to use the Platform as intended.
8. Limitation of Liability
To the maximum extent permitted by law:
- The Platform is provided on an "as is" and "as available" basis.
- Piriyathu LLP shall not be liable for indirect, incidental, consequential, or business-related losses.
- We are not responsible for the acts, omissions, or services of restaurants or third parties.
9. Indemnity
You agree to indemnify and hold harmless Piriyathu LLP from any claims, losses, damages, or liabilities arising out of:
- Your misuse of the Platform.
- Your violation of these Terms.
- Any unlawful activity conducted through your use of the Platform.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform after such updates constitutes acceptance of the revised Terms.
11. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the competent courts in India.
